TRUCK ACCIDENTS

Truck Accidents Can Be Devastating

Although car accidents can cause serious injuries, truck accidents tend to be particularly catastrophic, mainly because of the size and weight difference between a truck and a car. Trucks typically weigh 7 times more than cars, often times resulting in fatalities or serious or long-lasting injuries, such as:

  • broken bones
  • spinal cord injuries
  • amputations
  • abdominal injuries
  • neck injuries
  • head injuries, including concussions and other traumatic brain injuries

Don’t fight this battle alone, call us today at (770) 716-1306. You may be entitled to money.

Why Truck Accidents Happen
Here are some of the most common reasons truck accidents occur:

  • Speeding
  • Failure to properly secure a load
  • Improper Cargo
  • Mechanical Defects (tires, brakes, etc.)
  • Alcohol or Drug Use
  • Little to no training
  • Fatigue

Fatigue is a common cause for truck accidents. Truck driver fatigue is such an issue that the federal government created a department, specifically for monitoring commercial truck companies to help reduce trucking accidents that occur on our highways. That department is called the Federal Motor Carrier Safety Administration (FMCSA). Federal regulations mandate that truck drivers must have a minimum of 10 hours rest between shifts and must not log or work more than 60 hours in one week, or drive more than 10 hours in one day.

Unlike most drivers, commercial drivers are held to a higher standard. That is, commercial drivers have to apply for a special license, which is commonly known as CDL license.  In addition to a special license and adequate training and drug testing, commercial drivers also have to keep detailed logs of their departures and arrivals, including mileage, cargo, place of origins and place of departures, and hours driven.

Unlike car accidents, truck accidents are very complex. That’s because most, if not all, trucks have on-board computers, commonly referred to as a blackbox, keeping vital information on the truck driver’s speed and other vital information moments before an accident. Preserving evidence is critical in winning any case. Call us today at (770) 716-1306, as we have recovered millions of dollars for our clients.

SLIP AND FALLS

You may be unaware, but slip and fall accidents are the second leading cause of injuries in the United States. In many instances, injuries could have been avoided if the owner of the premises took steps to make the area safer.

Here are some of the damages that can be collected in a wrongful death claim:

  • Funeral and burial expenses
  • Medical expenses
  • Loss of income your love one contributed to the household
  • Loss of inheritance that would have accrued over time
  • Loss of household services your loved one provided
  • Loss of care and companionship

SURVIVAL CLAIM VS. WRONGFUL DEATH
A survival claim is pursued by the representative of the deceased’s estate. Money recovered from a survival claim is given to the estate of the deceased and distributed to the deceased’s heirs, which often includes family and others. Unlike a survival claim, a wrongful death claim is pursued directly by the deceased’s family members and the money is given to the family members.

Each case is different, and determining whether to pursue a wrongful death claim or a survival claim, should be discussed with an attorney. Call us today, so we can help you make the right decision and help you recover what’s rightfully yours. Our number is (770) 716-1306.
